Our Policy

The Talent Acquisition Portal® (TAP) is especially concerned about winning and maintaining the trust of the people in our community. Very often, we hear the question, “Will my privacy be respected?” The answer is a resounding “Yes!” TAP is dedicated not only to advocating on behalf of our community, but also to supporting an individual’s right to have their personal information held in the strictest confidence.

This Portal does not collect personally identifiable information about individuals except when specifically, knowingly and voluntarily provided by such individuals. A user’s personally identifiable information will not be transferred, sold or loaned to any third party unless otherwise stated at the time of collection.

TAP may use an adult user’s personally identifiable information to deliver to that user alone personalized content, relevant promotional offers and other directed messages. In all such cases, our intent is to better serve our community by providing individual users access to information, products and services that correspond with their personal preferences, expressed interests, or apparent site usage. Individuals have the right to stop their personally identifiable information from being used for such marketing and promotional purposes by sending an e-mail request to us at the address given at the end of this privacy policy. Also, any individual always has the right not to use the Talent Acquisition Portal® Web site and thereby not to receive any directed content at any time.

While your individual information is protected as outlined above, we reserve the right to use aggregated, anonymous data about our users as a group. For instance, we might report to potential advertisers that a certain percentage of our users are interested in Job Fairs, based on site usage or expressed interests.

TAP may use your IP address to help diagnose problems with our server, and to administer our Web site. Your IP address is also used to gather broad demographic information.

It should also be noted that this Web site contains links to other sites. TAP is not responsible for the privacy practices or the content of those Web sites. We may supplement personal information submitted by you with information from third party sources in order to reduce errors in our database, authenticate users and or prevent abuse of our system.

Accessibility

In our continuing effort to increase the functionality of our site, some sections of Talent Acquisition Portal® (TAP) may not be entirely compatible with accepted accessibility standards.

TAP is working to make these sections accessible as quickly as possible. In addition, some of our partners’ sites are not yet Bobby compliant; we are working with our partners to encourage increased accessibility.

If you use an assistive technology that is not compatible with our site or one of our partners’ sites, please email us at Support@tapability.org. TAP welcomes your feedback and hopes that you will be patient with us as we build this community together.

Responsibility and Liability

The Talent Acquisition Portal® (TAP) is a software application that is solely owned by the CSAVR/NET-disABLEDperson, Inc. Partnership. Its purpose is to connect our community members with employers looking to hire within our community. TAP is simply acting as a conduit to connect you the individual with a disability with a potential employer. Resume posting is free for our community members. TAP expressly disclaims any responsibility or liability for any damage, loss, or injury arising out of a relationship between one of our members and an employer who met on our site. Any difficulties that may arise between a community member and employer that have met on our site is solely between that community member and that employer and both will hold TAP/disABLEDperson, Inc./NET/CSAVR harmless for any liability, damage or loss.

Please check back periodically to be informed of any changes or additions to this policy. We do not anticipate that our philosophy of protecting user information from inappropriate uses and disclosures will change. However, as TAP will be engaged in an ongoing dialogue with private and public bodies (such as TrustE) to ensure that our usage guidelines remain up to date, this policy statement will be modified to reflect refinements, improvements, and changes in our Web site. Any personal information collected and maintained is subject to the version of the Privacy Policy in effect at the time the information was collected

Surveys

Our online surveys ask visitors for contact information (like their email address) and demographic information (like their zip code, age, or income level). The Talent Acquisition Portal® (TAP) uses contact data from our surveys to send the user information about our organization and promotional material targeted to a user’s expressed interests. Contact information may also be used to contact the user when necessary. Users may, however, opt-out of receiving future mailings, as described in the opt-out choice section below. Demographic and profile data is also collected at our site. TAP uses this data to tailor our user’s experience at our site, providing targeted information and services. This information is shared with advertisers on an aggregate basis.

Cookies (A Cookie is just one or more pieces of information stored as text strings on your machine)

The Talent Acquisition Portal® (TAP) may place a “cookie” in the browser files of the user’s computer. The cookie itself does not contain any personally identifiable information. Although the cookie could enable TAP to relate a user’s use of this site to information that the user has specifically and knowingly provided, TAP does not do so except in cases as outlined above, or under an official law enforcement directive, to comply with laws or regulations of governmental or regulatory body or in response to a valid subpoena, warrant or to protect the rights of NET/CSAVR/disABLEDperson, Inc. or others. We may use the Cookie to store your user ID.

If you don’t like cookies, your Web browser may include an option that allows you not to accept them. However, we don’t recommend using this option, since it makes browsing our site a less enjoyable and rich experience.

Parents

The Talent Acquisition Portal® (TAP) assures you that any personally identifiable information collected by this site from children under the age of 18 will not be transferred, sold, or provided to any third party.

TAP should be a place to explore as a family. TAP recommends that adults accompany children when using content on the Internet.

Opt-Out Choice

Users of our site always have the option not to provide us with personal information. If this information is not shared, however, the user will be denied the opportunity to receive targeted communications and offers from us or our partners. Additionally, if a user wants to remove certain pieces of information from our database so as not to receive future communications or to no longer receive our service altogether, that user can send an email to us at support@tapability.org asking us to remove that information.

Terms of Use

This page states the Terms of Use ("Terms") under which you ("You") may use the Talent Acquisition Portal® (TAP) and the Services (each as defined below). These Terms include the CSAVR/NET/disABLEDperson Inc. (“The Partnership”) Privacy Policy, which is incorporated into these Terms by reference.

These Terms constitute a binding agreement between You and “The Partnership”, operating the Talent Acquisition Portal®, and are deemed accepted by You each time that You use or access the Talent Acquisition Portal® Service. If you do not accept the Terms stated here, do not use the Talent Acquisition Portal®.

The Talent Acquisition Portal® (TAP) Services are defined as the application offered by “The Partnership”, the on-line service to post and search employment opportunities and may include any application accessed through the Facebook Platform and/or any mobile or other interface that allows You to access such application (either now or in the future”). TAP also allow Users to create individual profiles, which may include personal information (”Profiles/Resume”), and to make these Profiles/Resume, or aspects thereof available to employers within our system.

“The Partnership” may revise these Terms at any time by posting an updated version to this Web page. You should visit this page periodically to review the most current Terms because they are binding on You.

Users who violate these Terms may have their access and use of the Talent Acquisition Portal® suspended or terminated, at “The Partnership’s” discretion.

  1. Use of CSAVR/NET/disABLEDperson, Inc. (“The Partnership”) Content.

“The Partnership” authorizes You, subject to these Terms, to access and use the Talent Acquisition Portal® (TAP) content (as defined below) solely for Your personal, non-commercial use. The contents of TAP, such as designs, text, graphics, images, video, information, logos, button icons, software, audio files and other TAP content (collectively, " The Partnership Content"), are protected under copyright, trademark and other laws. All TAP Content is the property of “The Partnership” or its licensors. The compilation (meaning the collection, arrangement and assembly) of all content is the exclusive property of “The Partnership” and is protected by copyright, trademark, and other laws. Unauthorized use of the “The Partnership” Content may violate these laws and/or applicable communications regulations and statutes, and is strictly prohibited. You must preserve all copyright, trademark, service mark and other proprietary notices contained in the original CSAVR/NET Content on any authorized copy You make of the “The Partnership” Content.

Any code that “The Partnership” creates to generate or display any TAP Content or the pages making up TAP is also protected by “The Partnership” copyright and You may not copy or adapt such code.

You agree not to sell or modify the TAP Content or reproduce, display, publicly perform, distribute, or otherwise use the TAP Content in any way for any public or commercial purpose or infringe upon “The Partnership” or its licensor’s intellectual property rights. You further agree to in no other way misuse TAP Content. The use of the TAP Content on any other application, web site or in a networked computer environment for any purpose is prohibited. Any code that “The Partnership” creates to generate or display any “The Partnership” Content or the pages making up any Application or Service is also protected by “The Partnership” copyright and you may not copy or adapt such code.

  1. Use of the CSAVR/NET/disABLEDperson, Inc. (“The Partnership”) Services.

The job posting, resume database (“Talent Acquisition Portal® Resume Database”) and other features of the Talent Acquisition Portal® (TAP) may be used only by individuals seeking employment and/or career information and by employers seeking employees.
All Talent Acquisition Portal® (TAP) Users agree to not:

(a) transmit, post, distribute, store or destroy material, including without limitation TAP Content, in violation of any applicable law or regulation, including but not limited to laws or regulations governing the collection, processing, or transfer of personal information, or in breach of “The Partnership” privacy policy;
(b) take any action that imposes an unreasonable or disproportionately large load on any TAP infrastructure;
(c) use any device to navigate or search TAP other than the tools available on the Site, generally available third party web browsers, or other tools approved by “The Partnership”;
(d) use any data mining, robots or similar data gathering or extraction methods;
(e) violate or attempt to violate the security of TAP including attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization;
(f) forge any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting;
(g) reverse engineer or decompile any parts of TAP;
(h) aggregate, copy or duplicate in any manner any of the TAP Content or information available including expired job postings, other than as permitted by these Terms;
(i) frame or link to any TAP Content or information available unless permitted by these Terms;
(j) post any content or material that promotes or endorses false or misleading information or illegal activities, or endorses or provides instructional information about illegal activities or other activities prohibited by these Terms.
(k) share with a third party any login credentials to TAP;
(l) post or submit to TAP any incomplete, false or inaccurate biographical information or information which is not Your own;
(m) post content that contains restricted or password-only access pages, or hidden pages or images;
(n) solicit passwords or personally identifiable information from other Users;
(o) delete or alter any material posted by any other person or entity;
(p) harass, incite harassment or advocate harassment of any group, company, or individual;
(q) send unsolicited mail or email, make unsolicited phone calls or send unsolicited faxes promoting and/or advertising products or services to any User, or contact any users that have specifically requested not to be contacted by You;
(r) attempt to interfere with service to any User, host or network, including, without limitation, via means of submitting a virus to TAP, overloading, "flooding", "spamming", "mailbombing" or "crashing";
(s) use TAP for any unlawful purpose or any illegal activity, or post or submit any content, resume, or job posting that is defamatory, libelous, implicitly or explicitly offensive, vulgar, obscene, threatening, abusive, hateful, racist, discriminatory, of a menacing character or likely to cause annoyance, inconvenience, embarrassment, anxiety or could cause harassment to any person or include any links to pornographic, indecent or sexually explicit material of any kind, as determined the discretion of “The Partnership”.

Violations of system or network security may result in civil and/or criminal liability. “The Partnership” will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations.

You are responsible for maintaining the confidentiality of Your account, Profile and passwords, as applicable. You may not share Your password or other account access information with any other party, temporarily or permanently, and You shall be responsible for all uses of Your TAP registrations and passwords, whether or not authorized by You. You agree to immediately notify “The Partnership” of any unauthorized use of Your account, Profile, or passwords.

  1. Additional Terms Applicable to Employers. Employers are solely responsible for their postings on the Talent Acquisition Portal® (TAP). CSAVR/NET/disABLEDperson, Inc. (“The Partnership”) is not to be considered to be an employer with respect to Your use of any TAP service and “The Partnership” shall not be responsible for any employment decisions, for whatever reason, made by any entity posting jobs on TAP You understand and acknowledge that if You cancel Your employer account or Your employer account is terminated, all Your account information from TAP, will be marked as deleted. Your job postings will stay in our database indefinitely should you have a need for them in the future.

Job postings

A job posting may not contain:
(a) irrelevant hyperlinks, those not linking to appropriate career pages or application pages;
(b) misleading, unreadable, or "hidden" keywords, repeated keywords or keywords that are irrelevant to the job opportunity being presented, as determined by the reasonable discretion of “The Partnership”;
(c) the names, logos or trademarks of unaffiliated companies or company product pages.
(d) the names of colleges, cities, states, towns or countries that are unrelated to the posting;
(e) more than one job or job description, more than one location, or more than one job category, unless the product so allows;
(f) inaccurate, false, or misleading information; and
(g) material or links to material that exploits people in a sexual, violent or other manner, or solicits personal information..
You may not use Your Talent Acquisition Portal® (TAP) job posting to:
(a) post jobs in a manner that does not comply with applicable local, national and international laws, including but not limited to laws relating to labor and employment, equal employment opportunity and employment eligibility requirements, data privacy, data access and use, and intellectual property;
(b) post jobs that require citizenship of any particular country or lawful permanent residence in a country as a condition of employment, unless otherwise required in order to comply with law, regulations, executive order, or federal, state or local government contract;
(c) post jobs that include any screening requirement or criterion in connection with a job posting where such requirement or criterion is not an actual and legal requirement of the posted job;
(d) post jobs or other advertisements for competitors of TAP or post jobs or other content that contains links to any site competitive with TAP unless expressly agreed upon by “The Partnership”;
(e) sell, promote or advertise products or services;
(f) post any franchise, pyramid scheme, "club membership", distributorship, multi-level marketing opportunity, or sales representative agency arrangement;
(g) post any business opportunity that requires an up-front or periodic payment or requires recruitment of other members, sub-distributors or sub-agents;
(h) post any business opportunity that pays commission only unless the posting clearly states that the available job pays commission only and clearly describes the product or service that the job seeker would be selling;
(i) promote any opportunity that does not represent bona fide employment which is generally indicated by the employer’s use of IRS forms W-2 or 1099;
(j) post jobs on TAP for modeling, acting, talent or entertainment agencies or talent scouting positions;
(k) advertise sexual services or seek employees for jobs of a sexual nature;
(l) request the use of human body parts or the donation of human parts, including, without limitation, reproductive services such as egg donation and surrogacy;
(m) endorse a particular political party, political agenda, political position or issue;
(n) promote a particular religion;
(o) post jobs located in countries subject to economic sanctions of the United States Government; and
(p) except where allowed by applicable law, post jobs which require the applicant to provide information relating to his/her (i) racial or ethnic origin (ii) political beliefs (iii) philosophical or religious beliefs (iv) membership of a trade union (v) physical or mental health (vi) sexual life (vii) the commission of criminal offences or proceedings or (vii) age.
“The Partnership” reserves the right to remove any job posting or content from TAP, which in the reasonable exercise of “The Partnership’s” discretion, does not comply with the above Terms, or if any content is posted that “The Partnership” believes is not in the best interest of “The Partnership”.

If at any time during Your use of TAP, You made a misrepresentation of fact to “The Partnership” or otherwise misled “The Partnership” in regards to the nature of Your business activities, “The Partnership” will have grounds to terminate Your use of the “The Partnership” Services.

Use of the Talent Acquisition Portal® (TAP) Resume Database by Employers:
You shall use the TAP Resume Database as provided in these Terms. You shall use the TAP Resume Database in accordance with all applicable privacy and data protection laws, and You agree You shall not further disclose any of the data from TAP Resume Database to any third party.

You shall take appropriate physical, technical, and administrative measures to protect the data You have obtained from TAP Resume Database from loss, misuse, unauthorized access, disclosure, alteration or destruction. You shall not share Resume Database seat-based license login credentials with any other party.

The Talent Acquisition Portal® (TAP) Resume Database shall not be used:
(a) for any purpose other than as an employer seeking employees, including but not limited to advertising promotions, products, or services to any resume holders;
b) to make unsolicited phone calls or faxes or send unsolicited mail, email, or newsletters to resume holders or to contact any individual unless they have agreed to be contacted (where consent is required or, if express consent is not required, who has not informed you that they do not want to be contacted); or
(c) to source candidates or to contact job seekers or resume holders in regards to career fairs and business opportunities prohibited by Section 3.

In order to ensure a safe and effective experience for all of our customers, “The Partnership” reserves the right to limit the amount of data (including resume views) that may be accessed by You in any given time period. These limits may be amended in “The Partnership” sole discretion from time to time.

Purchasing Job Credits

Employer agrees by accepting these Terms that upon submitting their request to the Talent Acquisition Portal® (TAP) to purchase job credits that their credit card will be billed the appropriate stated amount.

Refunds for credit card job credit purchases will only be made should there be a malfunction during the credit card payment process. Examples of malfunctions may be: 1) duplicate billing. 2) no job credit given after the purchase. Refunds will not be given by employer deemed poor performance for their job posting or an employer over purchasing job credits.

Additional Terms

  1. Additional terms applicable to Job Seekers. When You or your Vocational Rehabilitation Counselor registers you on the Talent Acquisition Portal® (TAP) you are making the decision to place your profile on a system that’s purpose is to connect individuals with disabilities with employers who are looking to hire them. You are therefore voluntarily self- identifying yourself as a person with a disability. Profiles/Resumes that are searched by employers will be devoid of contact information. That means that an employer will have your work history, skill set, education history, etc. but not your name, phone number, email address or physical address. An employer can contact you from your profile however (again, they do not have any of your contact information). They can only identify you by your unique ID in our system. Your contact information will always stay private unless disclosed by you. The only exception to this is if you decide to respond to an employer’s inquiry and disclose information on your own or apply for a job. When applying for a job, your full name will then be presented to the employer. Any other contact or personal information will stay private and is up to the discretion of you to disclose to the employer. Your Profile/Resume can be updated by your Vocational Rehabilitation Counselor, but can never be "Published" to be seen by employers until You agree to the terms of joining the portal. You understand and acknowledge that You have no ownership rights in Your account and that if You delete Your TAP account you will lose any information that was inputted into it, and will no longer have any access to TAP unless re-invited. CSAVR/NET/disABLEDperson, Inc. (“The Partnership”) reserves the right to delete Your account and all of Your Information after a significant duration of inactivity.
  2. Policy Regarding Termination Of Users Who Infringe The Copyright Or Other Intellectual Property Rights Of Others. CSAVR/NET/disABLEDperson, Inc. (“The Partnership”) respects the intellectual property of others, and we ask our Users and content partners to do the same. The unauthorized posting, reproduction, copying, distribution, modification, public display or public performance of copyrighted works constitutes infringement of the copyright owners rights. As a condition to Your use of the Talent Acquisition Portal® (TAP), You agree not to use TAP to infringe the intellectual property rights of others in any way. “The Partnership” reserves the right to terminate the accounts of any Users, and block access to TAP of any Users who are repeat infringers of the copyrights, or other intellectual property rights, of others. The Talent Acquisition Portal® (TAP) Liability. TAP acts as, among other things a venue for (i) employers to post job opportunities and search for and evaluate job candidates with disabilities and (ii) candidates with disabilities to post resumes and Profiles and search for and evaluate job opportunities and (iii) Vocational Rehabilitation Counselors to work with their respective candidates and business to the betterment of both. TAP does not screen or censor the listings, including Profiles offered. TAP is not involved in the actual transaction between employers and candidates. As a result, TAP is not responsible for User Content, the quality, safety or legality of the jobs or resumes posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings and TAP makes no representations about any jobs, resumes or User Content on the TAP Sites. While TAP reserves the right in its sole discretion to remove User Content, job postings, resumes or other material from the TAP Site from time to time, TAP does not assume any obligation to do so and to the extent permitted by law, disclaims any liability for failing to take any such action. TAP Networking provides a venue for individuals to network for professional and personal purposes and TAP does not screen or censor the Profiles or User Content on the TAP Sites. TAP is not involved in the actual communications between Users. As a result, TAP has no control over the accuracy, reliability, completeness, or timeliness of the Profiles or User Content submitted on the TAP Site and makes no representations about any Profile or User Content on the TAP Site. Note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users with whom You come in contact through the TAP Site. By its very nature other people’s information may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled. We expect that You will use caution and common sense when using the TAP Site. Because User authentication on the Internet is difficult, TAP cannot and does not confirm that each User is who they claim to be. Because we do not and cannot be involved in User-to-User dealings or control the behavior of participants on any TAP Site, in the event that You have a dispute with one or more Users, You release TAP (and our agents and employees) from claims, demands and damages (actual and consequential and direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes to the fullest extent permitted by law. The TAP Site and the TAP Content may contain inaccuracies or typographical errors. TAP makes no representations about the accuracy, reliability, completeness, or timeliness of any TAP Site or the TAP Content. The use of the TAP Site and the TAP Content is at Your own risk. Changes are periodically made to the TAP Site and may be made at any time. TAP cannot guarantee and does not promise any specific results from use of TAP. No advice or information, whether oral or written, obtained by a User from TAP or through or from TAP shall create any warranty not expressly stated herein. If You are a California resident, You waive California Civil Code Section 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor." TAP encourages You to keep a back-up copy of any of Your User Content. To the extent permitted by law, in no event shall TAP be liable for the deletion, loss, or unauthorized modification of any User Content. If You believe that something on the Site violates these Terms please contact our designated agent set forth in Section 7 above. If notified of any content or other materials which allegedly do not conform to these Terms, TAP may in its sole discretion investigate the allegation and determine whether to remove or request the removal of the content. TAP has no liability or responsibility to Users for performance or nonperformance of such activities.
  3. Disclaimer of Warranty. TO THE FULLEST EXTENT POSSIBLE BY LAW, THE TALENT ACQUISITION PORTAL® (TAP) DOES NOT WARRANT THAT OUR SITE OR ANY TAP SERVICES WILL OPERATE ERROR-FREE OR THAT TAP AND ITS SERVERS ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. IF YOUR USE OF TAP OR THE TAP CONTENT RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA OR ANY OTHER COSTS, TAP IS NOT RESPONSIBLE FOR THOSE COSTS. THE TAP SITE AND TAP CONTENT ARE PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. TAP, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE AND NON-INFRINGEMENT. TAP MAKES NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE TAP CONTENT, SERVICES, SOFTWARE, TEXT, GRAPHICS, AND LINKS.
  4. Disclaimer of Consequential Damages. TO THE FULLEST EXTENT POSSIBLE BY LAW, IN NO EVENT SHALL THE TALENT ACQUISITION PORTAL® (TAP), ITS SUPPLIERS, OR ANY THIRD PARTIES MENTIONED ON TAP BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA, LOST EMPLOYMENT OPPORTUNITY OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE TAP AND THE TAP CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT TAP IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
